In particular, according to the new article 812 of the Civil Code, as amended by L. 5095/2024, “The declaration of renunciation of inheritance or acceptance of inheritance with the benefit of the inventory, acceptance or renunciation of the function of the executor or renunciation thereof and acceptance of the appointment of a guardian of the inheritance or renunciation thereof is made at the registry of the court of inheritance. With the procedure of the first paragraph, a declaration of acceptance of inheritance by the heir may also be submitted. In this case, the declarant has an obligation to appear with a lawyer’s attorney”.
As pointed out in the explanatory statement of Law 5095/2024, it is permissible and legal to draw up a deed of acceptance of inheritance by a lawyer, which then, and with the aim of taking the form of a public document, will be presented, with all the information mentioned in it documents, to the competent secretary of the inheritance court, where the relevant inheritance acceptance report will be drawn up, signed by his attorney and the secretary. A copy of the acceptance of inheritance report will be transferred to the competent mortgage registry or registered in the relevant Land Office, just like the corresponding notarial acts of acceptance of inheritance to date.
